Article R612-49 of the French Intellectual Property Code

If the patent application is likely to be rejected for one of the cases provided for in Article L. 612-12 (4°, 5°, 6° and 8°), the applicant is notified of the decision and the reasons for it. The notification shall specify the time limit for the applicant to submit observations or new claims.

The patent application is rejected:

if the applicant has not submitted observations or new claims within the time limit;

if the observations submitted are not accepted, or if the new claims do not remedy the irregularity.

Si la demande de brevet est susceptible d’être rejetée pour l’un des cas prévus à l’article L. 612-12 (4°, 5°, 6° et 8°), notification motivée en est faite au demandeur. La notification précise le délai qui lui est imparti pour présenter ses observations ou de nouvelles revendications.

La demande de brevet est rejetée :

-si le demandeur n’a pas présenté d’observations ou de nouvelles revendications dans le délai imparti ;

-si les observations présentées ne sont pas retenues, ou si les nouvelles revendications ne permettent pas de remédier à l’irrégularité.
