For the purposes of XII of Article L. 612-40 and subject to the second paragraph below, the Enforcement Committee’s decisions are published for at least five years in the AMF’s official register, which is accessible electronically. The type and nature of the infringement and the identity of the natural or legal person on whom the sanction has been imposed are mentioned.
Personal data is kept on the AMF’s official website in compliance with the rules set out in Act 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties.
Where applicable, the register also records appeals lodged against sanction decisions, their status and outcome.
Where a decision sanctions a breach of the rules set out in Sections 2 and 3 of Chapter III of Title I of Book V, the period for which the Enforcement Committee’s decision is kept in the AMF’s official register may not exceed ten years.
