Article R612-61 of the French Intellectual Property Code

If the subject matter of the new claims is not covered by the claims on the basis of which the search was carried out, the applicant shall be notified to pay the prescribed fee for the drawing up of a supplementary preliminary search report. If the person concerned does not comply with this request within the time limit set, the filing of the new claims is declared inadmissible and the patent is granted with the claims on the basis of which the search was carried out.

Si l’objet des nouvelles revendications n’est pas couvert par les revendications sur la base desquelles la recherche a été effectuée, notification est faite au demandeur d’avoir à acquitter la redevance prescrite pour l’établissement d’un rapport de recherche préliminaire complémentaire. Si l’intéressé ne défère pas à cette invitation dans le délai qui lui est imparti, le dépôt des nouvelles revendications est déclaré irrecevable et le brevet est délivré avec les revendications sur la base desquelles la recherche a été effectuée.
