Article R613-18 of the French Intellectual Property Code

The application for an operating licence provided for in Article L. 613-17 is sent to the Minister responsible for industrial property.

It shall indicate:

1° The surname, first names, profession, address and nationality of the applicant and, where applicable, the name of the person responsible for representing or assisting the applicant;

2° The patent for which the licence is requested;

3° Proof of the applicant’s qualifications, particularly from a legal, technical, industrial and financial point of view.

Within forty-eight hours of its receipt by the Minister, the application is notified to the owner of the patent and, where applicable, to the licensees entered in the National Patent Register.

La demande de licence d’exploitation prévue à l’article L. 613-17 est adressée au ministre chargé de la propriété industrielle.

Elle indique :

1° Les nom, prénoms, profession, adresse et nationalité du demandeur et, éventuellement, le nom de la personne chargée de le représenter ou de l’assister ;

2° Le brevet dont la licence est demandée ;

3° La justification de la qualification du demandeur notamment du point de vue légal, technique, industriel et financier.

Dans les quarante-huit heures de sa réception par le ministre, la demande est notifiée au propriétaire du brevet et, le cas échéant, aux titulaires de licences inscrites au Registre national des brevets.
