Article R613-19 of the French Intellectual Property Code

Within a maximum period of two months from receipt of the request, the committee referred to in Article R. 613-10 gives its opinion on the conditions for granting the exploitation licence, particularly as regards its duration and scope.

This opinion is notified to the licence applicant as well as to the patent owner and, where applicable, to the holders of licences entered in the National Patent Register. The Chairman of the Commission shall set the time limit within which the licence applicant, the patent proprietor and the licence holders must make known their observations on the conditions for granting the licence envisaged by the Commission.

These observations are submitted to the commission.

Dans le délai maximum de deux mois à compter de la réception de la demande, la commission visée à l’article R. 613-10 donne son avis sur les conditions d’octroi de la licence d’exploitation, notamment quant à sa durée et à son champ d’application.

Cet avis est notifié au demandeur de licence ainsi qu’au propriétaire du brevet et, le cas échéant, aux titulaires de licences inscrites au Registre national des brevets. Le président de la commission fixe le délai qui est imparti au demandeur de licence, au propriétaire du brevet et aux titulaires de licences pour faire connaître leurs observations sur les conditions d’octroi de la licence envisagées par la commission.

Ces observations sont soumises à la commission.
