Article R613-26 of the French Intellectual Property Code

The formal notice provided for in Article L. 613-18 (paragraph 1) shall be the subject of a reasoned decision by the Minister responsible for industrial property, taken after consultation with the Minister for the Economy and Finance and the Minister responsible for Scientific Research and Atomic and Space Issues. This decision specifies the needs of the national economy that have not been met.

The decision is notified, with its reasons, to the owner of the patent and, where applicable, to the licensees entered in the National Patent Register or to their representatives in France.

La mise en demeure prévue à l’article L. 613-18 (alinéa 1er) fait l’objet d’une décision motivée du ministre chargé de la propriété industrielle, prise après consultation du ministre de l’économie et des finances et du ministre chargé de la recherche scientifique et des questions atomiques et spatiales. Cette décision précise les besoins de l’économie nationale qui n’ont pas été satisfaits.

La décision est notifiée, avec ses motifs, au propriétaire du brevet et, le cas échéant, aux titulaires de licences inscrites au Registre national des brevets ou à leurs représentants en France.
