Article R613-3-6 of the French Monetary and Financial Code

For the application of IV of Article L. 613-20-4, the Autorité de contrôle prudentiel et de résolution shall take into account, in the reasons for its decision on a consolidated basis, the opinions and reservations expressed within the time limits mentioned in Article R. 613-1 A, as well as the risk assessment of the subsidiaries carried out by the other competent authorities concerned of a Member State of the European Union or of a State party to the Agreement on the European Economic Area.

The AMF shall communicate its decision taken on a consolidated basis to the relevant competent authorities of another Member State of the European Union or of a State party to the Agreement on the European Economic Area, to the parent institution or, where applicable, to the central body within the meaning of Article L. 511-30.

Pour l’application du IV de l’article L. 613-20-4, l’Autorité de contrôle prudentiel et de résolution tient compte, dans la motivation de sa décision sur base consolidée, des avis et des réserves exprimés dans les délais mentionnés à l’article R. 613-1 A, ainsi que de l’évaluation du risque des filiales réalisée par les autres autorités compétentes concernées d’un Etat membre de l’Union européenne ou d’un Etat partie à l’accord sur l’Espace économique européen.

L’Autorité communique sa décision prise sur base consolidée aux autorités compétentes concernées d’un autre Etat membre de l’Union européenne ou partie à l’accord sur l’Espace économique européen, à l’établissement mère ou, le cas échéant, à l’organe central au sens de l’article L. 511-30.
