Article R613-33 of the French Intellectual Property Code

Amendments to the terms of the exploitation licence requested either by the patent holder or by the holder of this licence shall be decided and published in accordance with the procedure prescribed for the grant of the said licence. If they relate to the amount of the royalties, they shall be decided in accordance with the procedure prescribed for the initial fixing of that amount.

The procedure for granting the exploitation licence shall also apply to the withdrawal of that licence requested by the owner of the patent for non-performance of the obligations imposed on the licensee.

Les modifications des clauses de la licence d’exploitation demandées soit par le titulaire du brevet, soit par le titulaire de cette licence sont décidées et publiées selon la procédure prescrite pour l’octroi de ladite licence. Si elles portent sur le montant des redevances, elles sont décidées selon la procédure prescrite pour la fixation initiale de ce montant.

La procédure d’octroi de la licence d’exploitation est également applicable au retrait de cette licence demandé par le propriétaire du brevet pour inexécution des obligations imposées au titulaire de la licence.
