I. – Pursuant to IV of Article L. 613-32-1, the Autorité de contrôle prudentiel et de résolution establishes a college of supervisors when a class 1 bis credit institution or investment firm subject to its supervision meets the following conditions:
1° This class 1 bis credit institution or investment firm has established branches of significant importance in other Member States of the European Union or parties to the agreement on the European Economic Area ;
2° This credit institution or this class 1 bis investment firm is not subject to any college of supervisors established on the basis of Article L. 613-20-2.
II. – The constitution and operation of this college are governed by written provisions defined by the Autorité de contrôle prudentiel et de résolution after consultation with the competent authorities concerned.
The college is chaired by the Autorité de contrôle prudentiel et de résolution. The Autorité determines which competent authorities participate in a meeting or activity of the college. The Autorité de contrôle prudentiel et de résolution shall take into account, in particular, the relevance of the supervisory activity to be planned or coordinated and the potential impact of the decisions that could be taken in the college on the stability of the financial system for the competent authorities concerned.
The Autorité de contrôle prudentiel et de résolution shall inform the members of the college in advance of the organisation of meetings, the main issues to be discussed and the activities to be examined.
The Autorité de contrôle prudentiel et de résolution shall inform the members of the college of the measures taken at the meetings or of the actions carried out.
