Article R613-36 of the French Intellectual Property Code

Following the notifications provided for in the preceding article, the owner of the patent application or patent shall make known to the Minister for Defence, by registered letter with acknowledgement of receipt, his claims as to the remuneration of the licence granted to the State.

The matter may not be referred to the judicial court with a view to fixing the amount of the remuneration, pursuant to Article L. 613-19 (fourth paragraph), before the expiry of a period of four months from the date of receipt of the above-mentioned registered letter.

A la suite des notifications prévues à l’article précédent, le propriétaire de la demande de brevet ou du brevet fait connaître au ministre de la défense, par lettre recommandée avec demande d’avis de réception, ses prétentions quant à la rémunération de la licence accordée à l’Etat.

Le tribunal judiciaire ne peut être saisi en vue de la fixation du montant de la rémunération, en application de l’article L. 613-19 (quatrième alinéa), avant l’expiration d’un délai de quatre mois à compter de la date de réception de la lettre recommandée ci-dessus mentionnée.
