Article R613-44-10 of the French Intellectual Property Code

The prosecution phase or the time limit laid down in the first paragraph of Article R. 613-44-8 shall be suspended:

1° At the written request of any person establishing that an action to claim ownership of the patent has been brought, or that, on the date on which the request for opposition is filed in accordance with Article R. 613-44-1, an application for invalidity of the same patent has been filed;

2° On the initiative of the National Institute of Industrial Property, pending information or elements likely to have an impact on the outcome of the opposition or the situation of the parties.
The investigation phase may also be suspended at the joint request of all the parties, for a period of four months, renewable twice.

The decision to suspend is notified to the parties.
The parties are notified of the suspension decision.

La phase d’instruction ou le délai fixé au premier alinéa de l’article R. 613-44-8 sont suspendus :


1° Sur requête écrite de toute personne établissant qu’une action en revendication de propriété du brevet a été intentée, ou, qu’à la date à laquelle la demande d’opposition est présentée conformément à l’article R. 613-44-1, une demande en nullité de ce même brevet a été formée ;


2° A l’initiative de l’Institut national de la propriété industrielle, dans l’attente d’informations ou d’éléments susceptibles d’avoir une incidence sur l’issue de l’opposition ou la situation des parties.


La phase d’instruction peut également être suspendue sur demande conjointe de toutes les parties, pendant une durée de quatre mois renouvelable deux fois.


La décision de suspension est notifiée aux parties.
