Article R613-44 of the French Intellectual Property Code

The opposition referred to in Article L. 613-23 shall be filed within a period of nine months following publication in the Bulletin officiel de la propriété industrielle of the mention of the grant of the contested patent.

It may be filed by a natural person or legal entity acting personally or through an agent meeting the conditions laid down in Article R. 612-2.

Natural or legal persons who do not have their domicile or registered office in a Member State of the European Union or in a State party to the Agreement on the European Economic Area must appoint a representative.

When the opposition is lodged jointly by two or more natural or legal persons, a representative must be appointed.
Where the opposition is lodged jointly by several persons, a joint representative meeting the same conditions must be appointed.

Where, in the opposition proceedings, the proprietor of the patent submits observations or proposals to amend the patent, the conditions of representation referred to in Article R. 612-2 shall apply.

L’opposition mentionnée à l’article L. 613-23 est formée dans le délai de neuf mois suivant la publication au Bulletin officiel de la propriété industrielle de la mention de la délivrance du brevet contesté.

Elle peut être présentée par une personne physique ou morale agissant personnellement ou par l’intermédiaire d’un mandataire remplissant les conditions prévues à l’article R. 612-2.

Les personnes physiques ou morales n’ayant pas leur domicile ou leur siège dans un Etat membre de l’Union européenne ou dans un Etat partie à l’accord sur l’Espace économique européen doivent constituer un mandataire.

Lorsque l’opposition est formée conjointement par plusieurs personnes, un mandataire commun satisfaisant aux mêmes conditions doit être constitué.

Lorsque dans le cadre de la procédure d’opposition le titulaire du brevet présente des observations ou des propositions de modification de ce brevet, les conditions de représentation mentionnées à l’article R. 612-2 s’appliquent.
