Article R613-48 of the French Intellectual Property Code

Where payment of an annual fee is not made by the normal due date, a warning shall be sent to the owner of the patent application or patent stating that he shall incur the forfeiture of his rights if such payment, together with that of the late fee, is not made before the expiry of the six-month period provided for in the first paragraph of article R. 613-47.

The absence of a warning does not engage the responsibility of the Institut national de la propriété industrielle and does not constitute a cause for restoration of the patent owner’s rights.

Article R613-48

Lorsque le paiement d’une redevance annuelle n’est pas effectué à la date de l’échéance normale, un avertissement est adressé au propriétaire de la demande de brevet ou du brevet lui indiquant qu’il encourt la déchéance de ses droits si ce paiement, accompagné de celui de la redevance de retard, n’est pas effectué avant l’expiration du délai de six mois prévu au premier paragraphe de l’article R. 613-47.

L’absence d’avertissement n’engage pas la responsabilité de l’Institut national de la propriété industrielle et ne constitue pas une cause de restauration des droits du propriétaire du brevet.
