Article R613-58 of the French Intellectual Property Code

In the event of non-compliance with an application for registration, the applicant will be notified and given reasons. The applicant is given a period in which to regularise the application or submit observations. In the absence of regularisation or observations allowing the objection to be removed, the application is rejected by decision of the Director General of the National Institute of Industrial Property.

The notification may be accompanied by a proposal for regularisation. In this case, the proposal is deemed to be accepted if the applicant does not contest it within the time limit set.

En cas de non-conformité d’une demande d’inscription, notification motivée en est faite au demandeur. Un délai lui est imparti pour régulariser sa demande ou présenter des observations. A défaut de régularisation ou d’observation permettant de lever l’objection, la demande est rejetée par décision du directeur général de l’Institut national de la propriété industrielle.

La notification peut être assortie d’une proposition de régularisation. Dans ce cas, cette proposition est réputée acceptée si le demandeur ne la conteste pas dans le délai qui lui est imparti.
