Article R613-58 of the French Monetary and Financial Code

For the purposes of Article L. 613-52-2, the resolution board may make use of the derogations provided for in I of that Article where it finds that one of the following conditions is met:

1° The actual or foreseeable failure of the person subject to the resolution procedure poses a significant threat to financial stability;

2° Application of the provisions of I of Article L. 613-50-6 would be likely to undermine the effectiveness of the business divestment measure in achieving the objectives of the resolution.

Pour l’application de l’article L. 613-52-2, le collège de résolution peut recourir aux dérogations prévues au I de cet article lorsqu’il constate que l’une des conditions suivantes est remplie :

1° La défaillance avérée ou prévisible de la personne soumise à la procédure de résolution fait peser une menace importante sur la stabilité financière ;

2° L’application des dispositions du I de l’article L. 613-50-6 aurait pour effet probable de nuire à l’efficacité de la mesure de cession des activités pour atteindre les objectifs de la résolution.
