Article R613-64 of the French Monetary and Financial Code

For the purposes of Article L. 613-55-1, the exclusion provided for in II of this Article of certain commitments that may be used for internal bail-in is intended in particular to prevent eligible deposits of natural persons and micro, small and medium-sized enterprises defined according to their annual turnover as mentioned in paragraph 1 of Article 2 of the Annex to European Commission Recommendation 2003/361/EC of 6 May 2003 from being affected by the contagion referred to in 3° of II of the same Article.

The disruptions to the operation of the financial markets referred to in the latter article include disruptions affecting the operation of market infrastructures.

Pour l’application de l’article L. 613-55-1, l’exclusion prévue au II de cet article de certains engagements utilisables pour un renflouement interne a notamment pour objet d’éviter que les dépôts éligibles des personnes physiques et des micro, petites et moyennes entreprises définies en fonction de leur chiffre d’affaires annuel mentionné au paragraphe 1 de l’article 2 de l’annexe à la recommandation 2003/361/CE du 6 mai 2003 de la Commission européenne soient affectés par le mouvement de contagion mentionné au 3° du II du même article.

Les perturbations du fonctionnement des marchés financiers mentionnées à ce dernier article s’entendent notamment des perturbations affectant le fonctionnement des infrastructures de marché.
