Article R6132-12 of the French Public Health Code

I.-The constituent agreement provides for the setting up of a grouping nursing, re-education and medico-technical care commission. This commission is made up of the chairmen and, in a number determined by the founding agreement, representatives of the nursing, rehabilitation and medico-technical care commissions of the healthcare establishments and representatives of paramedical professionals from the medico-social establishments or services that are part of the grouping.

When an army hospital is associated with the grouping, the commission is also made up of personnel occupying equivalent functions to those mentioned in the first paragraph for the representatives of the establishments involved.

The distribution of seats on the commission and the powers delegated to it by the nursing, rehabilitation and medico-technical care commissions of the establishments belonging to the grouping are determined by the founding agreement.

II – The chairman of the grouping’s nursing, re-education and medico-technical care committee is a general care coordinator, or a care director covered by the provisions of article L. 4138-2 of the Defence Code, appointed by the director of the grouping’s support establishment.

III – The opinions issued by the grouping’s nursing, rehabilitation and medico-technical care commission are forwarded to the members of the strategic committee and to each of the nursing, rehabilitation and medico-technical care commissions of the establishments involved in the regional hospital grouping, as well as to the equivalent body when an army hospital is involved in the grouping.

Article R6132-12

I.-La convention constitutive prévoit la mise en place d’une commission des soins infirmiers, de rééducation et médico-techniques de groupement. Cette commission est composée des présidents et, en nombre fixé par la convention constitutive, de représentants des commissions des soins infirmiers, de rééducation et médico-techniques des établissements de santé et de représentants des professionnels paramédicaux des établissement ou services médico-sociaux parties au groupement.

Lorsqu’un hôpital des armées est associé au groupement, la commission est composée également des personnels occupant des fonctions équivalentes à celles mentionnées au premier alinéa pour les représentants des établissements parties.

La répartition des sièges au sein de la commission et les compétences qui lui sont déléguées par les commissions des soins infirmiers, de rééducation et médico-techniques des établissements parties au groupement sont déterminées par la convention constitutive.

II.-Le président de la commission des soins infirmiers, de rééducation et médico-techniques de groupement est un coordonnateur général des soins, ou un directeur des soins relevant des dispositions de l’article L. 4138-2 du code de la défense, désigné par le directeur de l’établissement support du groupement.

III.-Les avis émis par la commission des soins infirmiers, de rééducation et médico-techniques de groupement sont transmis aux membres du comité stratégique et à chacune des commissions des soins infirmiers, de rééducation et médico-techniques des établissements parties au groupement hospitalier de territoire ainsi qu’à l’instance équivalente lorsqu’un hôpital des armées est associé au groupement.
