Article R6132-16 of the French Public Health Code

I.-The support institution is responsible for purchasing policy, planning, strategy and management control for all contracts and amendments thereto. It is responsible for awarding contracts and amendments to contracts in accordance with the provisions of the French Public Procurement Code.

The establishment that is part of the regional hospital grouping is responsible for executing these contracts in accordance with the provisions of the same ordinance.

II – A purchasing action plan for the regional hospital grouping is drawn up on behalf of the establishments involved in the grouping. When an army hospital is involved in the regional hospital grouping, it participates in drawing up this action plan.

III – In order to meet the needs of the armed forces hospital associated with the grouping, and subject to the prior agreement of the Minister of Defence, the support institution may award contracts and their amendments in the name and on behalf of the armed forces health service.

The agreement establishing the regional hospital grouping then stipulates that:

1° Either the armed forces health service is responsible for carrying out these contracts, in accordance with the provisions of the same code;

2° Or the support institution is responsible for executing these contracts in the name and on behalf of the armed forces health service. In this case, a special agreement between the support establishment and the army hospital specifies the conditions under which these contracts are to be performed.

Article R6132-16

I.-L’établissement support est chargé de la politique, de la planification, de la stratégie d’achat et du contrôle de gestion des achats pour ce qui concerne l’ensemble des marchés et de leurs avenants. Il assure la passation des marchés et de leurs avenants conformément aux dispositions du code de la commande publique.

L’établissement partie au groupement hospitalier de territoire assure l’exécution de ces marchés conformément aux dispositions de la même ordonnance.

II.-Un plan d’action des achats du groupement hospitalier de territoire est élaboré pour le compte des établissements parties au groupement. Lorsqu’un hôpital des armées est associé au groupement hospitalier de territoire, il participe à l’élaboration de ce plan d’action.

III.-Afin de répondre aux besoins de l’hôpital des armées associé au groupement et sous réserve de l’accord préalable du ministre de la défense, l’établissement support peut assurer la passation de marchés et de leurs avenants au nom et pour le compte du service de santé des armées.

La convention constitutive du groupement hospitalier de territoire prévoit alors que :

1° Soit l’exécution de ces marchés est assurée par le service de santé des armées, conformément aux dispositions du même code ;

2° Soit l’établissement support est chargé de l’exécution de ces marchés au nom et pour le compte du service de santé des armées. Une convention particulière entre l’établissement support et l’hôpital des armées précise alors les conditions de mises en œuvre de cette exécution.
