Article R6133-16 of the French Public Health Code

When the Director General of the Agence Régionale de Santé withdraws, or does not renew, an authorisation for healthcare activities granted to one or more members and operated jointly by the Groupement de Coopération Sanitaire, he withdraws authorisation for the Groupement to bill for the corresponding care and asks it to amend its constitutive agreement within a specified period. The Director General of the Regional Health Agency notifies the relevant health insurance bodies of this withdrawal.

If, at the end of this period, the Director General of the Regional Health Agency finds that the grouping has not sent him an amendment to its constituent agreement for approval, the Director General of the Regional Health Agency may dissolve the grouping in accordance with the procedure laid down in 3° of article R. 6133-8.

Article R6133-16

Lorsque le directeur général de l’agence régionale de santé retire, ou ne renouvelle pas, une autorisation d’activités de soins accordée à un ou plusieurs membres et exploitée en commun par le groupement de coopération sanitaire, il retire au groupement l’autorisation de facturer les soins correspondants et lui demande de modifier sa convention constitutive dans un délai déterminé. Ce retrait est porté à la connaissance des organismes d’assurance maladie compétents par le directeur général de l’agence régionale de santé.

S’il constate au terme de ce délai que le groupement ne lui a pas transmis d’avenant à sa convention constitutive pour approbation, le directeur général de l’agence régionale de santé peut dissoudre le groupement selon la procédure prévue au 3° de l’article R. 6133-8.
