Article R6133-28 of the French Public Health Code

The deliberations of the select committee referred to in article R. 6133-27 are recorded in the minutes of the meeting sent to the members of the grouping.

They are binding on all members, who have a period of one month from the date of notification of the deliberations in which to contest them before the select committee. The select committee has a period of one month from the date of receipt of the objection by a member to provide additional information to justify its position and reach an agreement. At the end of this period, if the disagreement persists, the director convenes, within a period of one month, an extraordinary general meeting which deliberates, by a qualified majority of two thirds of its members present or represented, on the maintenance or deletion of the deliberation of the select committee which is the subject of the dispute.

Les délibérations du comité restreint mentionné à l’article R. 6133-27 sont consignées dans un procès-verbal de réunion transmis aux membres du groupement.

Elles sont opposables à tous les membres qui disposent d’un délai d’un mois à compter de la date de notification des délibérations pour les contester auprès du comité restreint. Ce dernier dispose d’un délai d’un mois à compter de la date de réception de la contestation par un membre pour apporter des éléments complémentaires de nature à justifier sa position et à parvenir à un accord. A l’issue de ce délai, si le désaccord persiste, l’administrateur convoque, dans un délai d’un mois, une assemblée générale extraordinaire qui délibère, à la majorité qualifiée des deux tiers de ses membres présents ou représentés, sur le maintien ou la suppression de la délibération du comité restreint faisant l’objet de la contestation.
