I. – After it has been set up, a Groupement de Coopération Sanitaire may admit new members by decision of the General Meeting. This decision is required in respect of any new health care organisation formed by the absorption or merger of one or more health care organisations that are members of the grouping.
II. – During the term of the Constituent Agreement, any member may withdraw from the Grouping at the end of a financial year, provided that it has notified the Grouping of its intention at least six months before the end of the financial year and that the arrangements for such withdrawal comply with the stipulations of the Constituent Agreement.
III. – When the Grouping has at least three members, the General Meeting may decide to exclude any one of them in the event of failure to comply with the obligations defined in section 2 of this chapter, the constituent agreement and the decisions of the General Meeting. Exclusion may also be ordered in the event of the opening of safeguard, receivership or liquidation proceedings. Exclusion may only be ordered after the representative of the member concerned has been heard in accordance with the procedures laid down in the constituent agreement.
IV. – The accession of a new member, the withdrawal and exclusion of a member give rise to an amendment to the constituent agreement.
