Article R614-11 of the French Intellectual Property Code

The translation of the claims of the European patent application referred to in Article L. 614-9 shall be drawn up by the applicant. The text is submitted to the National Institute of Industrial Property by the applicant, together with a request for publication and proof of payment of the fee due.

The request for publication is declared inadmissible if it is not accompanied by proof of payment of the fee.

An indication that the translation of the claims has been supplied shall be published in the Official Bulletin of Industrial Property within one month of the date on which it was supplied. This notice shall include the information necessary for identification of the patent application.

From the day of publication of the notice referred to in the previous paragraph, any person may inspect the text of the translation free of charge at the National Institute of Industrial Property and obtain a copy at his own expense.

La traduction des revendications de la demande de brevet européen mentionnée à l’article L. 614-9 est établie par le demandeur. Son texte est remis à l’Institut national de la propriété industrielle par le demandeur, accompagné d’une réquisition de publication et de la justification du paiement de la redevance exigible.

La réquisition de publicité est déclarée irrecevable si elle n’est pas accompagnée de la justification du paiement de la redevance.

Mention de la remise de la traduction des revendications est publiée au Bulletin officiel de la propriété industrielle dans le délai d’un mois à compter de la date à laquelle elle a été fournie. Cette mention comporte les indications nécessaires à l’identification de la demande de brevet.

A compter du jour de la publication de la mention mentionnée à l’alinéa précédent, toute personne peut prendre connaissance gratuitement à l’Institut national de la propriété industrielle du texte de la traduction et en obtenir reproduction à ses frais.
