The annual fees provided for in Article L. 612-19 which are due for the European patent must be paid under the conditions provided for in Article 141 of the European Patent Convention. These fees are deducted from the filing date of the European patent application.
Where the proprietor of a European patent has filed an application for unitary effect, he may pay within a period of three months from the date of service of the decision rejecting the application for unitary effect which is no longer subject to appeal :
1° Fees that have fallen due between the date of publication of the mention of the grant of the European patent in the European Patent Register and the date of service referred to in the second paragraph;
2° Fees that have fallen due within three months of the date of service referred to in the second paragraph.
Where payment of an annual fee has not been made by the expiry of the period referred to in paragraph 2 of Article 141 of the European Patent Convention signed in Munich on 5 October 1973 or by the expiry of the period referred to in the second paragraph of this Article, the said fee may be validly paid within an additional period of six months, subject to payment of a late fee within the same period.
