Article R6141-10 of the French Public Health Code

Without prejudice to the application of the provisions ofarticle L. 6122-1 :

1° Public health establishments with national or inter-regional jurisdiction are created by decree after obtaining the opinion of the Comité national de l’organisation sanitaire et sociale;

2° Public health establishments with regional jurisdiction are created by decree after obtaining the opinion of the commission specialising in the organisation of care of the Conférence régionale de la santé et de l’autonomie ;

3° Public health establishments under communal, inter-communal and departmental jurisdiction are created by order of the Director General of the Regional Health Agency for the region in which the establishment’s head office is located, after consulting the specialised commission for the organisation of care of the Regional Conference on Health and Autonomy and the commune in which the establishment’s head office is located.

Sans préjudice de l’application des dispositions de l’article L. 6122-1 :

1° Les établissements publics de santé à ressort national, ou interrégional sont créés par décret après avis du Comité national de l’organisation sanitaire et sociale ;

2° Les établissements publics de santé à ressort régional sont créés par décret après avis de la commission spécialisée de l’organisation des soins de la conférence régionale de la santé et de l’autonomie ;

3° Les établissements publics de santé à ressort communal, intercommunal et départemental sont créés par arrêté du directeur général de l’agence régionale de santé de la région où est situé le siège de l’établissement après avis de la commission spécialisée de l’organisation des soins de la conférence régionale de la santé et de l’autonomie et de la commune où est situé le siège de l’établissement.
