The conversion of one or more public health establishments, as provided for in article L. 6141-7-1, is decided by order of the Director General of the Regional Health Agency for the region in which the head office of the resulting establishment is located, after consulting the supervisory board of the establishment or establishments concerned and the municipality in which the head office of the establishment is located. However, the decision is taken by decree when it concerns a public health establishment with national, inter-regional or regional jurisdiction.
The decision defines the procedures for the transfer of assets and liabilities and specifies the nature of the authorisations transferred to the new institution by virtue of the provisions of the last paragraph of article L. 6141-7-1. It designates the local authority or public establishment to which the legacies and donations are to be transferred. Subject to the provisions of article L. 6145-10, the legacies and donations are transferred to this local authority or establishment with the same allocation.
The staff are transferred to the new establishment, which becomes their employer by virtue of the provisions of the second paragraph of article L. 6141-7-1.
When a public health institution is created in application of the second paragraph of article L. 6141-1, its first set of internal regulations is drawn up by the Director for a period that may not exceed twenty-four months, pending the constitution of the Management Board and the Supervisory Board.
