Article R6141-64 of the French Public Health Code

The staff of hospital foundations may be :

1° Civil servants working for a public legal entity mentioned inarticle 2 of law no. 83-634 of 13 July 1983 on the rights and obligations of civil servants and placed in a position in accordance with their status;

2° Contractual agents governed by decree no. 86-83 of 17 January 1986 relating to the general provisions applicable to contractual agents of the State taken for the application ofarticle 7 of law no. 84-16 of 11 January 1984 relating to statutory provisions concerning the civil service of the State and placed at the disposal of the Foundation;

3° Hospital practitioners seconded to the Foundation or placed at its disposal;

4° Private law employees.

Les personnels des fondations hospitalières peuvent être :


1° Des fonctionnaires relevant d’une personne morale de droit public mentionnée à l’article 2 de la loi n° 83-634 du 13 juillet 1983 portant droits et obligations des fonctionnaires et placés dans une position conforme à leur statut ;


2° Des agents contractuels régis par le décret n° 86-83 du 17 janvier 1986 relatif aux dispositions générales applicables aux agents contractuels de l’Etat pris pour l’application de l’article 7 de la loi n° 84-16 du 11 janvier 1984 portant dispositions statutaires relatives à la fonction publique de l’Etat mis à disposition de la fondation ;


3° Des praticiens hospitaliers détachés auprès de la fondation ou mis à disposition ;


4° Des salariés de droit privé.
