Article R6145-48 of the French Public Health Code

The services which public health institutions may provide on a subsidiary basis, as provided for in article L. 6145-7, are developed within the limits of the material and human resources essential to the performance of the tasks defined in articles L. 6111-1 and L. 6112-1.

In the event that the charges for the provision of services are set by the establishment, the prices charged to third parties, with the exception of those relating to services operated in the interest of the staff, may under no circumstances be lower than the cost price of the services, calculated on the basis of the cost accounting implemented in accordance with article R. 6145-7.

Les prestations de services que les établissements publics de santé peuvent assurer à titre subsidiaire, ainsi que le prévoit l’article L. 6145-7, sont développées dans la limite des moyens matériels et humains indispensables à l’exécution des missions définies aux articles L. 6111-1 et L. 6112-1.

Dans le cas où la tarification des prestations de services est fixée par l’établissement, les prix opposables aux tiers, à l’exception de ceux afférents aux services exploités dans l’intérêt des personnels, ne peuvent en aucun cas être inférieurs aux coûts de revient des prestations, calculés à partir de la comptabilité analytique mise en oeuvre conformément à l’article R. 6145-7.
