Article R6145-78 of the French Public Health Code

I.-As soon as the Director General of the Regional Health Agency is aware of a project to create a subsidiary or to acquire a direct or indirect holding, he will send the documents mentioned in article R. 6145-77 to the Rector of the academic region for his opinion in the case of projects concerning training activities or projects concerning the exploitation of research activities and their results. In French Guyana, the Director General of the Regional Health Agency sends these documents to the Regional Delegate for Research and Technology for projects concerning the exploitation of research activities and their results.

II. -The Director General of the Regional Health Agency shall oppose the creation of a subsidiary or the acquisition of a direct or indirect shareholding by a university hospital centre if he finds that one or more of the following conditions are met:

1° The plan to create a subsidiary or to acquire a direct or indirect shareholding does not comply with the conditions laid down in Article L. 6145-7 or articles R. 6145-74 to R. 6145-77;

2° The plan to create a subsidiary or to acquire a direct or indirect holding presents a financial risk that is clearly incompatible with improving or maintaining the financial equilibrium of the university hospital centre. The Director General of the Regional Health Agency shall establish this risk after obtaining the opinion of the Regional Director of Public Finance or, in the case of Assistance Publique-Hôpitaux de Paris, the Financial Controller;

3° The university hospital centre does not have an enforceable statement of projected income and expenditure or an approved multi-annual global financing plan.

Article R6145-78

I.-Dès que le directeur général de l’agence régionale de santé a connaissance d’un projet de création de filiale ou de prise de participation directe ou indirecte, il transmet pour avis les documents mentionnés à l’article R. 6145-77 au recteur de région académique pour les projets concernant des activités de formation ou pour les projets concernant la valorisation des activités de recherche et de leurs résultats. En Guyane, le directeur général de l’agence régionale de santé transmet au délégué régional à la recherche et à la technologie ces documents pour les projets concernant la valorisation des activités de recherche et de leurs résultats.

II.-Le directeur général de l’agence régionale de santé s’oppose à la création de filiale ou à la prise de participation directe ou indirecte par un centre hospitalier universitaire lorsqu’il constate qu’une ou plusieurs des conditions suivantes sont remplies :

1° Le projet de création de filiale ou de prise de participation directe ou indirecte ne respecte pas les conditions fixées à l’article L. 6145-7 ou aux articles R. 6145-74 à R. 6145-77 ;

2° Le projet de création de filiale ou de prise de participation directe ou indirecte présente un risque financier manifestement incompatible avec l’amélioration ou le maintien de l’équilibre financier du centre hospitalier universitaire. Le directeur général de l’agence régionale de santé constate ce risque après avis du directeur régional des finances publiques ou, pour l’Assistance publique-Hôpitaux de Paris, du contrôleur financier ;

3° Le centre hospitalier universitaire ne dispose pas d’un état de prévisions de recettes et de dépenses exécutoire ou d’un plan global de financement pluriannuel approuvé.
