Article R6152-12 of the French Public Health Code

The practitioner must return to his post within two months of receiving the notification provided for in the last paragraph of article R. 6152-8, unless a dispensation is granted by the Director General of the Centre National de Gestion on a proposal from the Director of the establishment to which he has been appointed after receiving the opinion of the head of the unit to which he has been assigned.

If the person concerned does not return to his post, his appointment is revoked after formal notice. In the case of a first appointment, he loses the benefit of his registration on the list of suitable candidates. In the case of an appointment following a request for transfer, the interested party is deemed to have obtained his transfer.

The practitioner must establish his or her actual residence close to the place where he or she carries out his or her duties in conditions compatible with the responsibilities he or she exercises in the public hospital service, after validation, where applicable, by the Director General of the Regional Health Agency.

Le praticien doit rejoindre son poste dans le délai de deux mois à compter de la réception de la notification prévue au dernier alinéa de l’article R. 6152-8, sauf dérogation accordée par le directeur général du Centre national de gestion sur proposition du directeur de l’établissement dans lequel il est nommé après avis du chef du pôle d’affectation.

Si l’intéressé ne rejoint pas son poste, sa nomination est rapportée après mise en demeure. Dans le cas d’une première nomination, il perd le bénéfice de son inscription sur la liste d’aptitude. Dans le cas d’une nomination consécutive à une demande de mutation, l’intéressé est réputé avoir obtenu sa mutation.

Le praticien doit établir sa résidence effective à proximité du lieu d’exercice de ses fonctions dans des conditions compatibles avec les responsabilités qu’il exerce dans le service public hospitalier, après validation, le cas échéant, du directeur général de l’agence régionale de santé.
