Article R6152-314 of the French Public Health Code

The rapporteur shall investigate the case by all means likely to enlighten the Disciplinary Board; he shall draw up a written report containing a statement of the facts and the arguments of the parties and shall forward it to the chairman of the Disciplinary Board.

If the rapporteur has relied on new information to investigate the case, the Chairman must order the documents used to be communicated and postpone the date of the Disciplinary Board meeting so that the practitioner has additional time, the duration of which is set by the Chairman, to prepare a defence.

The rapporteur attends the meeting of the Disciplinary Board in an advisory capacity and reads out his report in the presence of the practitioner concerned and, where applicable, the defence counsel assisting him. He may provide any additional observations.

Le rapporteur instruit l’affaire par tous les moyens propres à éclairer le conseil de discipline ; il établit un rapport écrit contenant l’exposé des faits et les moyens des parties et le transmet au président du conseil de discipline.

Si le rapporteur s’est appuyé sur des éléments nouveaux pour instruire l’affaire, le président doit ordonner la communication des pièces utilisées et reporter la date de la réunion du conseil de discipline afin que le praticien dispose d’un délai supplémentaire, dont la durée est fixée par le président pour préparer une défense.

Le rapporteur assiste avec voix consultative à la séance du conseil de discipline devant lequel il donne lecture de son rapport en présence du praticien intéressé et, le cas échéant, du défenseur qui l’assiste. Il peut fournir toutes observations complémentaires.
