Practitioners governed by this section participate in continuity of care or pharmaceutical duty with other practitioners in the establishment.
To this end, the practitioners:
1° In facilities organised on a continuous basis, carry out day and night work under the conditions defined by the internal regulations and the duty roster;
2° In other facilities, carry out daily morning and afternoon work and, in addition, participate in continuity of care or pharmaceutical duty organised either on site or on call at home;
3° Whatever the facility, participate in replacements required by the various leaves or occasional absences of practitioners in the facility.
When the interests of the service so require, the director of the establishment, after obtaining the opinion of the chairman of the establishment’s medical committee, may decide to suspend the participation of a contractual practitioner in continuity of care or pharmaceutical duty at night, on Saturday afternoons, Sundays and public holidays for a maximum period of three months.
At the end of this period, if the practitioner is not authorised to participate again in continuity of care or pharmaceutical duty, he will be subject to the procedure relating to professional inadequacy or the disciplinary procedure provided for in this section.
The director of the establishment may exempt a practitioner from participating in continuity of care or pharmaceutical duty under conditions specified by order of the Minister for Health.
