Article R6152-389 of the French Public Health Code

A practitioner who, within six years of the contractual termination, is recruited to take up a post in the establishment from which he/she received a specific contractual termination indemnity is required to reimburse this establishment, at the latest within two years of his/her recruitment, for the sums received by way of this indemnity.

Prior to his recruitment, the candidate selected to occupy, as a public employee, a post in an establishment mentioned inarticle 2 of law no. 86-33 of 9th January 1986 on statutory provisions relating to the hospital civil service shall send the recruiting authority a statement on his honour that he has not received a specific severance pay from this establishment during the six years prior to his recruitment.

Le praticien qui, dans les six années suivant la rupture conventionnelle, est recruté pour occuper un emploi dans l’établissement dont il a perçu une indemnité spécifique de rupture conventionnelle est tenu de rembourser à cet établissement, au plus tard dans les deux ans qui suivent son recrutement, les sommes perçues au titre de cette indemnité.


Préalablement à son recrutement, le candidat retenu pour occuper, en qualité d’agent public, un emploi dans un établissement mentionné à l’article 2 de la loi n° 86-33 du 9 janvier 1986 portant dispositions statutaires relatives à la fonction publique hospitalière adresse à l’autorité de recrutement une attestation sur l’honneur qu’il n’a pas bénéficié de la part de cet établissement, durant les six années précédant le recrutement, d’une indemnité spécifique de rupture conventionnelle.
