Article R6152-411 of the French Public Health Code

Contractual practitioners are recruited by the director of the public health establishment on a proposal from the head of the division or, failing that, the head of the department, the functional unit or any other internal structure to which the practitioner reports and the chairman of the establishment’s medical committee.

The number of practitioners recruited in application of 1° to 4° of article R. 6152-402 for a period of less than three months, expressed as a full-time equivalent, may not exceed the number of permanent practitioners and practitioners appointed or recruited for a period of more than three months exercising their functions in the structure to which they are assigned as well as in the discipline of activity within the establishment.

A six-monthly statement of the number of contractual practitioners recruited for a period of less than three months is drawn up by structure and by discipline of activity and sent to the Director General of the Regional Health Agency by the Director of the establishment.

Les praticiens contractuels sont recrutés par le directeur de l’établissement public de santé sur proposition du chef de pôle ou, à défaut, du responsable du service, de l’unité fonctionnelle ou de toute autre structure interne dont relève le praticien et du président de la commission médicale d’établissement.

Le nombre de praticiens recrutés en application des 1° à 4° de l’article R. 6152-402 pour une durée inférieure à trois mois, exprimé en équivalent temps plein, ne peut excéder celui des praticiens titulaires et des praticiens nommés ou recrutés pour une durée de plus de trois mois exerçant leurs fonctions dans la structure où ils sont affectés ainsi que dans la discipline d’activité au sein de l’établissement.

Un état semestriel des effectifs de praticiens contractuels recrutés pour une durée inférieure à trois mois est établi par structure et par discipline d’activité et transmis au directeur général de l’agence régionale de santé par le directeur de l’établissement.
