Article R6152-413 of the French Public Health Code

In the event of serious misconduct or professional inadequacy, the Director may, after communicating the grievances to the person concerned and inviting him to present his observations within a period of eight days, terminate the contract by a reasoned decision taken after consulting the head of the division or, failing that, the head of the department, the functional unit or any other internal structure and the establishment’s medical committee and notified to the contractual practitioner concerned.

In the absence of an opinion from the institutional medical committee within two months of its convening, only the opinion of its chairman is required.

En cas de faute grave ou d’insuffisance professionnelle, le directeur peut, après avoir communiqué les griefs à l’intéressé et l’avoir invité à présenter ses observations dans le délai de huit jours, mettre fin au contrat par décision motivée prise après avis du chef de pôle ou, à défaut, du responsable du service, de l’unité fonctionnelle ou de toute autre structure interne et de la commission médicale d’établissement et notifiée au praticien contractuel concerné.

A défaut d’avis de la commission médicale d’établissement rendu dans les deux mois de sa convocation, seul l’avis de son président est requis.
