Article R6152-428 of the French Public Health Code

The establishment and the practitioner recruited under an open-ended contract may jointly agree on the terms of termination of the contract between them.

The contractual termination is the result of an agreement signed by both parties. The agreement defines the terms and conditions of the contractual termination, in particular the amount of the specific contractual termination indemnity within limits determined by decree.

The contractual termination agreement may not be imposed by either party.

L’établissement et le praticien recruté par contrat à durée indéterminée peuvent convenir en commun des conditions de la rupture du contrat qui les lie.

La rupture conventionnelle résulte d’une convention signée par les deux parties. La convention de rupture définit les conditions de celle-ci, notamment le montant de l’indemnité spécifique de rupture conventionnelle dans des limites déterminées par décret.

La rupture conventionnelle ne peut être imposée par l’une ou l’autre des parties.
