Article R6152-433 of the French Public Health Code

In addition to the amount of the specific contractual termination indemnity, the agreement also sets the date on which the practitioner’s contract will end. This will take place at the earliest one day after the end of the withdrawal period provided for in article R. 6152-434.

The contractual termination agreement is drawn up in accordance with the model defined by an order of the Minister responsible for the civil service.

The agreement is signed at least fifteen clear days after the last interview, on a date set by the director of the establishment or his representative.

Each party receives a copy of the agreement.

A copy of the agreement is placed in the practitioner’s personal file.

Outre le montant de l’indemnité spécifique de rupture conventionnelle, la convention fixe notamment la date de fin de contrat du praticien. Celle-ci intervient au plus tôt un jour après la fin du délai de rétractation prévu à l’article R. 6152-434.

La convention de rupture conventionnelle est établie selon le modèle défini par un arrêté du ministre chargé de la fonction publique.

La signature de la convention a lieu au moins quinze jours francs après le dernier entretien, à une date arrêtée par le directeur de l’établissement ou son représentant.

Chaque partie reçoit un exemplaire de la convention.

Une copie de la convention est versée au dossier individuel du praticien.
