The hospital practitioner seeking an assignment is authorised to take the leave mentioned in articles R. 6152-35 to R. 6152-41 by the Director General of the Centre national de gestion. However, when he is working in one of the host organisations mentioned in article R. 6152-50, annual leave, reduced working hours and time off for recuperation, as well as exceptional leave of absence, are granted by the competent authority of this organisation, which immediately notifies the Centre national de gestion.
The provisions of article R. 6152-801 apply to the hospital practitioner seeking an assignment when he is working in one of the establishments mentioned in article L. 6141-1, in proportion to the length of time worked. When he/she performs his/her duties in other organisations, the hospital practitioner benefits from days of reduced working time under the conditions in force within the host organisation where he/she performs his/her activity.
For the application of the provisions of articles R. 6152-36 to R. 6152-41 to the practitioner seeking a new assignment, the competent medical committee is that of the department in which the person concerned resides. The matter is referred to the medical committee by the director general of the Centre national de gestion.
When the hospital practitioner seeking a posting benefits from one of the leaves provided for in articles R. 6152-36 to R. 6152-41 and article R. 6152-35-2 for a period of more than four consecutive months, the period between the first day of the fifth month of leave and the date on which his condition allows him to resume a professional activity or, failing that, the date on which his leave entitlement expires, is not taken into account when determining the duration of the search for an assignment as provided for in the fifth paragraph of article R. 6152-50-1.
