Article R6152-532 of the French Public Health Code

In the event of professional inadequacy, the contract may be terminated without compensation or notice following the approval of the establishment’s medical committee. In the event of an emergency, the director of the establishment may, until this opinion is given, suspend the assistant from his/her duties for a period which may not exceed one month; during this suspension, the person concerned retains all the emoluments mentioned in 1° of article R. 6152-514.

In the absence of an opinion from the hospital medical committee within two months of its being convened, only the opinion of its chairman is required.

En cas d’insuffisance professionnelle, il peut être mis fin au contrat sans indemnité, ni préavis sur avis conforme de la commission médicale d’établissement. En cas d’urgence, le directeur de l’établissement peut, jusqu’à l’intervention de cet avis, suspendre l’assistant de ses fonctions pour une durée qui ne peut excéder un mois ; l’intéressé conserve pendant la durée de cette suspension la totalité des émoluments mentionnés au 1° de l’article R. 6152-514.

A défaut d’avis de la commission médicale d’établissement rendu dans un délai de deux mois à compter de sa convocation, seul l’avis de son président est requis.
