Article R6152-548 of the French Public Health Code

Associate midwives are entitled to annual leave of twenty-five working days. Associate midwives working part-time are entitled to this leave in proportion to the number of days they work.

During these days of leave and the additional days of rest granted as part of the reduction in working hours in application of decree no. 2002-9 of 4 January 2002 relating to working hours and the organisation of work in the establishments mentioned in article 2 of law no. 86-33 of 9 January 1986 on statutory provisions relating to the hospital civil service, they receive the emoluments mentioned in 1° of article R. 6152-545.

The duration of the leave and additional rest days mentioned above that may be taken at one time may not exceed thirty-one consecutive days.

The director of the establishment draws up the table of leave and additional rest days for associate midwives after obtaining the opinion of the head of the department or the person in charge of the internal structure.

Les sages-femmes associées ont droit à un congé annuel de vingt-cinq jours ouvrés. Les sages-femmes associées exerçant leur activité à temps partiel bénéficient de ce droit au prorata de leur quotité de travail.

Pendant ces jours de congés et les jours supplémentaires de repos accordés au titre de la réduction du temps de travail en application du décret n° 2002-9 du 4 janvier 2002 relatif au temps de travail et à l’organisation du travail dans les établissements mentionnés à l’article 2 de la loi n° 86-33 du 9 janvier 1986 portant dispositions statutaires relatives à la fonction publique hospitalière, elles perçoivent les émoluments mentionnés au 1° de l’article R. 6152-545.

La durée des congés et jours supplémentaires de repos mentionnés ci-dessus pouvant être pris en une seule fois ne peut excéder trente et un jours consécutifs.

Le directeur de l’établissement arrête le tableau des congés et jours supplémentaires de repos des sages-femmes associées après avis du chef de pôle ou du responsable de la structure interne.
