Article R6152-630-9 of the French Public Health Code

Practitioners who, within six years of the contractual termination, are recruited to take up a post in the establishment from which they received a specific contractual termination indemnity are required to reimburse this establishment, at the latest within two years of their recruitment, for the sums received in respect of this indemnity.

Prior to their recruitment, candidates selected to occupy a post as a public employee in an establishment mentioned inarticle 2 of law no. 86-33 of 9th January 1986 on statutory provisions relating to the hospital civil service shall send the recruiting authority a statement on their honour to the effect that they have not received a specific severance pay from this establishment during the six years prior to recruitment.

Les praticiens qui, dans les six années suivant la rupture conventionnelle, sont recrutés pour occuper un emploi dans l’établissement dont ils ont perçu une indemnité spécifique de rupture conventionnelle sont tenus de rembourser à cet établissement, au plus tard dans les deux ans qui suivent leur recrutement, les sommes perçues au titre de cette indemnité.

Préalablement à leur recrutement, les candidats retenus pour occuper, en qualité d’agent public, un emploi dans un établissement mentionné à l’article 2 de la loi n° 86-33 du 9 janvier 1986 portant dispositions statutaires relatives à la fonction publique hospitalière adressent à l’autorité de recrutement une attestation sur l’honneur qu’ils n’ont pas bénéficié de la part de cet établissement, durant les six années précédant le recrutement, d’une indemnité spécifique de rupture conventionnelle.
