The disciplinary penalties applicable to practitioners covered by this section are :
1° A warning ;
2° a reprimand
3° Reduction in seniority leading to a reduction in emoluments;
4° Suspension for a period not exceeding six months with total or partial withdrawal of emoluments;
5° Automatic transfer;
6° dismissal.
A warning or reprimand is pronounced by the Director General of the Centre National de Gestion, after obtaining the opinion of the Director General of the Regional Health Agency, the Director of the establishment and the establishment’s Medical Commission sitting in a formation restricted to permanent practitioners, and after the interested party has been notified of his file. Reasons are given for these decisions.
The opinion of the establishment medical committee is given within two months of the date on which it is convened. Failing this, the reasoned opinion of the Chairman of the Institutional Medical Committee alone is required.
Other penalties are imposed by a reasoned decision of the Director General of the Centre National de Gestion after receiving the opinion of the Disciplinary Board.
