Article R6152-74 of the French Public Health Code

The disciplinary penalties applicable to practitioners covered by this section are :

1° A warning ;

2° a reprimand

3° Reduction in seniority leading to a reduction in emoluments;

4° Suspension for a period not exceeding six months with total or partial withdrawal of emoluments;

5° Automatic transfer;

6° dismissal.

A warning or reprimand is pronounced by the Director General of the Centre National de Gestion, after obtaining the opinion of the Director General of the Regional Health Agency, the Director of the establishment and the establishment’s Medical Commission sitting in a formation restricted to permanent practitioners, and after the interested party has been notified of his file. Reasons are given for these decisions.

The opinion of the establishment medical committee is given within two months of the date on which it is convened. Failing this, the reasoned opinion of the Chairman of the Institutional Medical Committee alone is required.

Other penalties are imposed by a reasoned decision of the Director General of the Centre National de Gestion after receiving the opinion of the Disciplinary Board.

The composition and operating procedures of the Disciplinary Board are laid down in subsection 2 of section 3 of this chapter.

Les sanctions disciplinaires applicables aux praticiens relevant de la présente section sont :

1° L’avertissement ;

2° Le blâme ;

3° La réduction d’ancienneté de services entraînant une réduction des émoluments ;

4° La suspension pour une durée ne pouvant excéder six mois avec suppression totale ou partielle des émoluments ;

5° La mutation d’office ;

6° La révocation.

L’avertissement et le blâme sont prononcés par le directeur général du Centre national de gestion, après avis du directeur général de l’agence régionale de santé, du directeur de l’établissement, de la commission médicale d’établissement siégeant en formation restreinte aux praticiens titulaires, et après communication de son dossier à l’intéressé. Ces décisions sont motivées.

L’avis de la commission médicale d’établissement est rendu dans un délai de deux mois à compter de la date de sa convocation. A défaut, l’avis motivé du président de la commission médicale d’établissement est alors seul requis.

Les autres sanctions sont prononcées par décision motivée du directeur général du Centre national de gestion après avis du conseil de discipline.

La composition et les modalités de fonctionnement du conseil de discipline sont fixées par la sous-section 2 de la section 3 du présent chapitre.
