The case is referred to the Disciplinary Board by the Director General of the Centre National de Gestion.
The practitioner concerned must be notified at least two months in advance, by registered letter with acknowledgement of receipt, of the date of his appearance before the Disciplinary Board and be given full access to his file. He may submit written or oral observations to the Disciplinary Board, call witnesses and be assisted by a defender of his choice.
The administration also has the right to call witnesses.
The Disciplinary Board shall hear all persons it deems necessary to summon. It shall take note of the observations of the Director General of the Regional Health Agency, the Director of the establishment and the Medical Committee of the establishment where the practitioner works, sitting in a formation restricted to permanent practitioners and without the presence of the practitioner.
The Disciplinary Board may order any additional investigation likely to enlighten it.
