Article R6152-78 of the French Public Health Code

A practitioner who has been the subject of a disciplinary penalty and who has not been excluded from the service may, after five years in the case of a warning or reprimand and ten years in the case of any other penalty, request the Director General of the Centre national de gestion that no trace of the penalty remain in his file.

The Director General of the National Management Centre shall take a decision after obtaining the opinion of the Disciplinary Board, where the latter has been consulted prior to the imposition of the penalty.

If necessary, the practitioner’s file is reconstituted under the supervision of the Disciplinary Board.

Le praticien qui a fait l’objet d’une sanction disciplinaire et qui n’a pas été exclu des cadres peut, après cinq années, s’il s’agit d’un avertissement ou d’un blâme, et dix années, s’il s’agit de toute autre peine, demander au directeur général du Centre national de gestion qu’aucune trace de la sanction ne subsiste à son dossier.

Le directeur général du Centre national de gestion statue après avis du conseil de discipline lorsque celui-ci a été consulté préalablement à la sanction.

S’il y a lieu le dossier du praticien est reconstitué sous le contrôle du conseil de discipline.
