Article R6152-820 of the French Public Health Code

When it has been medically established by the medical committee mentioned in article R. 6152-36 that the person concerned is unfit to hold his post, the appointing authority shall seek to redeploy him. The offer of redeployment made to the person concerned shall be in writing and precise. It concerns the posts for which the appointing authority is responsible. The person concerned is invited to make known his/her decision within one month of being notified of the offer. In the absence of a reply from the person concerned, or in the event of a negative reply, or if the person concerned cannot be redeployed, he/she will be dismissed or struck off the staff list.

Lorsqu’il a été médicalement constaté par le comité médical mentionné à l’article R. 6152-36 que l’intéressé se trouve atteint d’une inaptitude à occuper son emploi, l’autorité investie du pouvoir de nomination cherche à le reclasser. L’offre de reclassement proposée à l’intéressé est écrite et précise. Elle concerne les emplois relevant de l’autorité ayant le pouvoir de nomination. L’intéressé est invité à faire connaître sa décision dans le délai d’un mois à compter de la notification de l’offre. A défaut de réponse de l’intéressé ou en cas de réponse négative de sa part ou lorsque le reclassement de l’intéressé s’avère impossible, celui-ci est licencié ou rayé des cadres.
