Article R6153-1-5 of the French Public Health Code

The provisions of articles R. 6153-2, with the exception of the first paragraph of I, to R. 6153-2-5 relating to working hours are applicable to junior doctors.

In application of article L. 4111-1-1, junior doctors may, at their request, be authorised to take part in medical on-call duty as part of their training period service obligations and taking into account teaching requirements.

This authorisation is issued by the director of the host structure, in agreement with the practitioner to whom they report, for the remaining duration of the training period, and after obtaining the opinion of the head of department. It is forwarded to the Association Council with which the junior doctor is registered. The Council of the Order will include the junior doctor’s ability to perform medical on-call duty on the special register mentioned in article R. 6153-1-1.

The list of specialities in which this authorisation may be granted is set by order of the Minister for Health.

Les dispositions des articles R. 6153-2, à l’exception du premier alinéa de son I, à R. 6153-2-5 relatives au temps de travail sont applicables aux docteurs juniors.

En application de l’article L. 4111-1-1, le docteur junior, à sa demande, peut être autorisé à participer, dans le cadre de ses obligations de service en stage et compte tenu des nécessités pédagogiques, au service de gardes et astreintes médicales.

Cette autorisation est délivrée par le directeur de la structure d’accueil, en accord avec le praticien dont il relève, pour la durée restante du stage, et après avis du chef de service. Elle est transmise au conseil de l’ordre auquel le docteur junior est inscrit. Le conseil de l’ordre fait figurer au tableau spécial mentionné à l’article R. 6153-1-1 la capacité du docteur junior à assurer des gardes ou des astreintes médicales.

La liste des spécialités dans lesquelles cette autorisation peut être accordée est fixée par arrêté du ministre chargé de la santé.
