Article R6153-106 of the French Public Health Code

Hospital students in maieutics are entitled to:

1° Annual leave of thirty working days, during which they receive the remuneration provided for in article R. 6153-105;

2° In the event of illness or infirmity duly certified as having made it impossible for them to carry out their duties, a maximum of one month’s leave, during which they receive their full remuneration, and one month, during which they receive half their remuneration.

In all cases, they retain their entitlement to the full family allowances;

3° Maternity, adoption or paternity leave of a duration equal to that provided for by social security legislation, during which the full remuneration provided for in article R. 6153-105 is paid.

Cash benefits due to the persons concerned under social security legislation are deducted from the remuneration or half-remuneration paid during sick leave, maternity leave, adoption leave or paternity leave.

In addition, the persons concerned may, at their request and with the agreement of the maieutics training structure and the director of the establishment supporting the training structure, benefit from an additional period of unpaid leave of thirty working days.

Les étudiants hospitaliers en maïeutique ont droit :


1° A un congé annuel de trente jours ouvrables pendant lequel ils perçoivent la rémunération prévue à l’article R. 6153-105 ;


2° En cas de maladie ou d’infirmité dûment constatée les mettant dans l’impossibilité d’exercer leurs fonctions, au maximum à un mois de congé pendant lequel ils perçoivent la totalité de leur rémunération et à un mois pendant lequel ils perçoivent la moitié de cette rémunération.


Dans tous les cas, ils conservent leurs droits à la totalité des suppléments pour charges de famille ;


3° A un congé de maternité, d’adoption ou de paternité d’une durée égale à celle prévue par la législation de la sécurité sociale, pendant lequel l’intégralité de la rémunération prévue à l’article R. 6153-105 est versée.


Les prestations en espèces dues aux intéressés au titre de la sécurité sociale viennent en déduction de la rémunération ou de la demi-rémunération servie durant le congé de maladie, de maternité, d’adoption ou de paternité.


En outre, les intéressés peuvent, sur leur demande et après accord de la structure de formation en maïeutique et du directeur de l’établissement support de la structure de formation, bénéficier d’un congé supplémentaire de trente jours ouvrables non rémunéré.
