Article R6153-12 of the French Public Health Code

Residents are entitled to thirty working days’ annual leave, Saturdays being counted as working days; during this leave, they receive the remuneration mentioned in article R. 6153-10 and in 1° and 3° of article D. 6153-10-1. The amount of leave that may be taken at any one time may not exceed twenty-four working days.

The reference year for calculating interns’ leave starts on the first Monday in November.

At the end of the reference year and provided that the number of days of annual leave taken during this reference year is not less than twenty-four, the intern is entitled to a compensatory allowance for each day of annual leave not taken, up to a maximum of six working days, the terms of payment of which are set by order of the ministers responsible for health and the budget.

Article R6153-12

L’interne a droit à un congé annuel de trente jours ouvrables, le samedi étant décompté comme jour ouvrable ; au cours de ce congé, il perçoit les rémunérations mentionnées à l’article R. 6153-10 et aux 1° et 3° de l’article D. 6153-10-1. La durée des congés pouvant être pris en une seule fois ne peut excéder vingt-quatre jours ouvrables.

L’année de référence pour le décompte des congés des internes commence le premier lundi du mois de novembre.

A l’issue de l’année de référence et sous réserve que le nombre de jours de congés annuels pris au cours de cette année de référence ne soit pas inférieur à vingt-quatre, l’interne a droit à une indemnité compensatrice pour chaque jour de congés annuels non pris, dans la limite de six jours ouvrables, dont les modalités de versement sont fixées par arrêté des ministres chargés de la santé et du budget.
