Article R6153-19 of the French Public Health Code

For the application of articles R. 6153-14 to R. 6153-18, the matter is referred to the medical committee either by the director general of the regional health agency of the subdivision to which the resident is assigned, or by the director of the health establishment to which the resident is assigned, or by the director general of the university hospital centre; in the latter two cases, the matter is referred after obtaining the opinion of the chairman of the establishment’s medical committee.

The resident whose case is submitted to a medical committee is notified at least fifteen days in advance of the date of the medical committee meeting. If so requested, the resident shall provide the medical committee with the medical documents in his possession.

The intern must appear before the Medical Committee. He may ask to be heard by one or more doctors of his choice, who shall have access to the file compiled by the Medical Committee.

Pour l’application des articles R. 6153-14 à R. 6153-18, le comité médical est saisi soit par le directeur général de l’agence régionale de santé de la subdivision d’affectation, soit par le directeur de l’établissement de santé d’affectation, soit par le directeur général du centre hospitalier universitaire, dans ces deux derniers cas, la saisine est effectuée après avis du président de la commission médicale d’établissement.

L’interne dont le cas est soumis à un comité médical est avisé, au moins quinze jours à l’avance, de la date de la réunion du comité médical. Si la demande lui en est faite, l’interne communique au comité médical les pièces médicales en sa possession.

L’interne est tenu de se présenter devant le comité médical. Il peut demander que soient entendus un ou plusieurs médecins de son choix, qui ont accès au dossier constitué par le comité médical.
