Article R6153-24-4 of the French Public Health Code

Applications for trade union training leave must be submitted in writing to the director of the establishment to which the trainee is assigned at least one month in advance. In the absence of an express reply no later than the fifteenth day prior to the start of the course or session, the leave is deemed to have been granted.

This leave shall take place during the course in which the request is made.

This leave may only be refused if the requirements of the service prevent it. Reasons must be given for any refusal.

At the end of the training course or session, the training centre or institute issues a certificate of attendance, which the person concerned gives to the director of the establishment to which he/she is assigned when he/she resumes his/her duties.

La demande de congé pour formation syndicale est adressée par écrit au directeur de l’établissement d’affectation en stage au moins un mois à l’avance. A défaut de réponse expresse au plus tard le quinzième jour qui précède le début du stage ou de la session, le congé est réputé accordé.


Ce congé a lieu durant le stage au cours duquel la demande est présentée.


Le bénéfice de ce congé ne peut être refusé que si les nécessités du service s’y opposent. Le refus doit être motivé.


Le centre ou l’institut de formation délivre, à la fin du stage ou de la session, une attestation d’assiduité que l’intéressé remet au directeur de l’établissement d’affectation en stage au moment de la reprise de fonctions.
