The matter is referred to the Disciplinary Board by the Director General of the university hospital centre to which the intern is attached, at the request, if appropriate, of the Director of the establishment or organisation where the intern is doing his training.
The intern being prosecuted is informed that he or she has thirty days in which to acquaint himself or herself with his or her case file, including all the information submitted to the Disciplinary Board, and to present his or her defence. They are also notified, at least fifteen days in advance, of the date of their appearance before the Board.
The accused person may submit written or oral observations to the Disciplinary Board, call witnesses and be assisted by a counsel of his choice.
The administration also has the right to call witnesses.
The Chairman, or the rapporteur designated by him within the section, may call any person he deems useful to be heard and may ask the authority that referred the matter to the Board for any additional information.
